I continue the series of articles about children’s rights in educational organizations. One of the residents of the Chelyabinsk region raised the issue of discrimination against children on benefits in schools regarding the organization of meals. His son complained that other children at the neighboring tables were fed better. Let me clarify that the category of beneficiaries includes children of military personnel, from low-income families, orphans, children with disabilities and some others. As it turned out, in school canteens children on benefits eat at a separate table and their menu differs from the menu of students who do not have nutritional benefits. So, for example, the menu of beneficiaries does not contain meat products, fruits, and in general the content of dishes is reduced to a minimum. Let’s say a child with benefits goes to his table and sees only buckwheat on his plate, and on other tables - plates with buckwheat and cutlet + apple .How acceptable is such a situation? And what does the law say about this? Firstly, the Education Law talks about the inadmissibility of any discrimination against students. Secondly, children on benefits in an educational organization must be provided with two free hot meals (breakfast and lunch). Thirdly , SanPiN regulates absolutely identical nutritional conditions for both beneficiaries and children without benefits. Funds for providing nutrition can be allocated both from the budget of the subject (school) and from the municipal budget. Almost always, when it comes to ensuring the rights of children (the right to a tutor, to nutritious food, to additional classes for underachieving students), school administration appeals to the lack of subsidies). However, when the proceedings move to a higher level, the administration miraculously finds funds.
